Online Store Terms: Use and Restrictions

• Use our Platform or products purchased through the Platform for any illegal or unauthorized purpose or violate any laws in your jurisdiction, including but not limited to copyright laws;
• Transmit any viruses, malware, or any code of a malicious or destructive nature; or
• Use any meta tags, collect or use any collection product description content

Any breach or violation of any of the Terms will result in immediate termination of your use of the Platform and/or our product(s) and service(s).

Creating and Managing Your Account

When prompted to create an account with us while using our website, it is at your discretion to do so, and you are solely responsible for ensuring the confidentiality of your account and all its information and for all activities conducted under your account.

You agree to indemnify, defend, and hold harmless Pupworld, Pupworldwear, its subsidiaries, affiliates, and their respective directors, partners, employees, contractors, and agents against any liabilities, claims, losses, and expenses, as a result of your breach of the Terms and Conditions, your violation of any laws or regulations, your violation of any third-party right, or any misrepresentation made by you. In the event that we suffer any damage as a result of your breach of these terms, you will be responsible for any and all loss caused.

General Dispute Resolution and Jurisdiction

In the event that a dispute arises regarding the Terms of Use, you agree to try to resolve the matter with Pupworld and its affiliates through negotiations, mediations, or arbitration prior to initiating a court action. In any action or proceeding arising out of these Terms, the prevailing party shall be entitled to reimbursement of costs and legal fees.

All Terms and Conditions provided shall be governed by and construed in accordance with the laws of Canada. All litigation and legal proceedings will take place exclusively in Vancouver, BC.

Terms of Sale ("Terms of Sale") entails Pupworld's terms and conditions in selling products through the Platform to you. By using or purchasing through our Platform or Websites, you agree to these terms and conditions and all terms references herein.

Placing an Order

When 1) you place an order, 2) we accept and process your order, 3) we ship your order, the contract of sale is formed. Upon placing an order, you will be required to provide information such as your name, contact information, shipping address, and a valid payment method. It is your responsible to review all product descriptions including but not limited to size, colour, price, add-on surcharges, intended use, lead time, return policy, shipping information and fees, applicable taxes and custom duties.

Use of Products

Pupworld is not responsible for any damages, accidents, and/or injuries caused by the use of our products. It is your responsibility to review our product descriptions carefully including each product's intended use and to evaluate and determine whether our products are suitable for your dog(s) based on considerations such as size, strength, behaviour, reactivity, and your intended use. By purchasing our products, you acknowledge that you have assessed the suitability of our products to YOUR intended use and assume any and all liability that may arise during the course of using our products with your dogs.

Product Display

All product and lifestyle images found on the Platform are for illustrative purposes only. Product colours and details may vary slightly from website images, and specific product looks recreated on your dog may look different from the Platform Lookbook with other dogs. We make every effort to display colours, placement, and details as accurately as possible, but we cannot guarantee how each element will display on your device.

Product Availability and Restrictions

All products are subject to availability. We reserve the right to limit the sales of our products to any person or geographic region, and we reserve the right to set product purchase limits in quantity or dollar amount for any products we offer.

Right to Cancel an Order

We reserve the right to reject or cancel any order placed by you at any time without liability for any costs other than repayment of any amount received from the cancelled order.

IN ADDITION TO THE GENERAL DISPUTE RESOLUTION outlined under Terms of Use and above for reference, to the extent permissible by law, the maximum aggregate liability under the Terms of Sale for any order placed through our Platform for any dispute that may arise, whether in contract, tort and negligence, strict liability or otherwise, is limited to the amount paid to Pupworld for the product(s) purchased in related order(s). The maximum aggregate liability will not exceed 100% of the price paid for the product(s) in any event.
